Redundancy
What is Redundancy?
Redundancy means that a job is going to disappear or that work has stopped or significantly reduced or that the need to employ someone to carry out a particular kind of work has reduced significantly or may even have stopped altogether. (E.g. computerisation may significantly diminish the workload in an admin department)
Redundancy is a dismissal in law and as such if it is carried out incorrectly, the affected employee has the right to submit a claim of Unfair Dismissal to an Employment Tribunal.
There is an established procedure, recognised by ACAS and the Employment Tribunals and clearly evident in case law for carrying out redundancies. Failure to adhere to this procedure is sufficient for a redundancy dismissal to be found to be unfair.
